Terms of Service

1. About Ericeira Kit

Ericeira Kit is a rental service based in Ericeira, Portugal, offering surfboards, wetsuits, yoga mats, beach accessories, baby equipment, and related gear (collectively, “Equipment”) to tourists and visitors.

The service is legally operated by:

By placing a booking, you agree to these Terms of Service in full.

2. Rental Agreement

A booking constitutes a rental agreement between you and Marcin Waldemar Fabianczyk (trading as Ericeira Kit). You must be at least 18 years old to place a booking.

• Pickup: 12:00 (noon) on the start date.
• Return: 12:00 (noon) on the end date.
• Late Returns: Returning Equipment after 12:00 on the return date will result in an additional full-day charge at the applicable daily rate.

3. Identification and Security

To protect our equipment, Ericeira Kit requires a security guarantee at the time of handover. You may choose one of the following:

Option A (ID Verification): We will perform a visual check and take a digital photograph of your valid government-issued ID (Passport or National ID). This data is stored securely for the duration of the rental and is deleted upon the safe return of the Equipment, in accordance with GDPR.

Option B (Cash Deposit): A cash security deposit of at least €100 (or higher depending on the value of the Equipment) is required. This deposit is returned in full upon successful inspection of the Equipment at return.

4. Pricing and Payment

• Prices are shown in Euros (€).
• VAT: Prices are exempt from VAT under Artigo 53.º do CIVA (Exemption regime).
• Changes: We reserve the right to update pricing; the price at the time of booking will be honored.
• Delivery: A delivery and collection service is available for a flat fee of €10 per booking (max distance 10 km from Ericeira).

5. Cancellations and Changes

All bookings are non-refundable. Date changes are subject to availability and must be requested by email at hello@ericeirakit.pt.

6. Care, Damage, and Loss

You are responsible for the Equipment during the rental period. Equipment must be returned in the same condition as received.

Repair Prices:

• Minor Ding (<5 cm): €50
• Major Ding / Rail Damage: €80+
• Fin Box Repair: €80
• Lost / Broken Fin: €30 per fin / €80 per set
• Lost / Cut Leash: €35

Other Equipment: Repairable damage to wetsuits or accessories will be charged at actual cost or a minimum of €20.

Total Loss:If Equipment is lost, stolen, or damaged beyond repair (e.g., a “snapped” surfboard), you will be charged the full Replacement Value with price of the new item (€450–€650 for surfboards).

We reserve the right to charge the card on file or deduct these costs from the cash deposit.

7. Liability

Ericeira Kit is not liable for any injury, loss, or damage arising from the use of rented Equipment. You use all Equipment at your own risk. You are responsible for ensuring you have the appropriate skill and insurance.

8. Governing Law and Disputes

These Terms are governed by the laws of Portugal.

• Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts of Mafra, Portugal.
• Complaints: You may also submit a complaint via the official Electronic Complaints Book (Livro de Reclamações Eletrónico).
